You are instantly protected if you have booked a package holiday through a UK tour operator by the Package Travel, Package Holidays and Package Tours Regulations 1992. These laws outline that the tour operator is responsible for your safety and wellbeing during your holiday and allows you pursue a claim for compensation relating to food poisoning or illness as a result of negligence.

The time limit to bring a claim is usually 3 years from the date of contracting illness. For a child that has fallen ill during a package holiday, you can act as a litigation friend prior to their 18th birthday, otherwise the child has until 3 years from their 18th birthday to bring a case to court.
